Tecalemit, Inc. (“Seller”) warrants to the Buyer that all equipment and parts manufactured by Seller will be free from defects in material and workmanship, under normal use and service, for a period of two years from the date of original shipment.

Exclusions: Custom-build workmanship and build-only components — including, but not limited to, cabinets, tanks, dolly wheels, frames, and cord reels — carry a one-year warranty.

This warranty does not apply to any equipment or parts that have been subjected to damage, abuse, neglect, misuse, improper operation, failure to follow the manufacturer’s operating instructions and conditions, or any alteration performed outside Seller’s direction.

This warranty does not extend to products or components not manufactured by the Seller but furnished as part of Seller’s equipment (such as motors, starters, thermometers, controls, etc.). For these items, Seller conveys to the Buyer the warranty, if any, of the component manufacturer, to the extent such warranty is transferable without additional cost to Seller.

THIS WARRANTY IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESSED OR IMPLIED (INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE), and in lieu of all other obligations or liabilities on the part of the Seller. Seller does not assume, nor authorize any other person to assume, any obligation or liability beyond what is expressly stated herein. Seller’s liability is limited to the purchase price of the equipment.

Seller shall not be liable for any loss of profit, plant shutdown, non-operation or increased operating costs, loss of product or materials, or any other special, incidental, or consequential damages. Seller’s sole obligation under this warranty is, at Seller’s option, repair or replacement of defective goods. If the original product is no longer available, Seller may replace it with a similar product of equal or greater value. Buyer’s exclusive remedy for breach of warranty is the enforcement of these obligations.

Charges for shipping and insuring products to Tecalemit, Inc. are the Buyer’s responsibility. Tecalemit, Inc. will return warrantied products via ground shipping at no charge for deliveries within the contiguous United States. International shipping charges and customs fees, both to and from Tecalemit, Inc., are the Buyer’s responsibility.

Buyer’s acceptance of delivery of equipment constitutes acceptance of this warranty policy and all associated terms, conditions, and limitations.

This document shall be governed by and construed in accordance with the laws of the United States and the State of Texas.
